PRIVACY POLICY

OF THE B22-SERVICE.COM ONLINE STORE

GENERAL PROVISIONS

This Privacy Policy of the Online Store is for informational purposes only, which means it does not create obligations for Service Recipients or Customers. It mainly describes the rules of personal data processing by the Controller in the Online Store, including the legal bases, purposes, scope of processing, rights of data subjects, and information about cookies and analytics tools.

Using the Online Store, including making purchases, is voluntary. Providing personal data is also voluntary, subject to two exceptions: (1) entering into agreements with the Controller – failure to provide data necessary to conclude and perform a Sales Agreement or Electronic Service agreement makes it impossible to conclude such an agreement; (2) statutory obligations of the Controller – providing personal data may be required by law, for example for tax or accounting purposes.

The Controller takes special care to protect the interests of persons whose data is processed and ensures in particular that data is processed lawfully, collected for specified lawful purposes, factually correct and adequate, stored no longer than necessary, and properly secured.

Taking into account the nature, scope, context, and purposes of processing as well as the risk to the rights and freedoms of natural persons, the Controller implements appropriate technical and organizational measures in accordance with the GDPR. These measures are reviewed and updated when needed. The Controller also uses safeguards to prevent unauthorized access to or modification of electronically transmitted personal data.

All terms written with a capital letter in this Privacy Policy should be understood in accordance with the definitions contained in the Terms and Conditions of the Online Store.

LEGAL BASES FOR DATA PROCESSING

The Controller is entitled to process personal data whenever at least one of the following conditions is met: the data subject has given consent; processing is necessary for the performance of a contract or steps taken prior to entering into a contract; processing is necessary to comply with a legal obligation; or processing is necessary for the legitimate interests pursued by the Controller or a third party.

Each instance of personal data processing requires at least one of the legal bases listed above. Specific legal bases are indicated below for the relevant processing purposes.

PURPOSE, LEGAL BASIS, AND RETENTION PERIOD

The purpose, legal basis, retention period, and recipients of personal data depend on the actions taken by a given Service Recipient or Customer in the Online Store or by the Controller. For example, if a Customer chooses personal pickup instead of courier delivery, their personal data will be processed to perform the Sales Agreement but will not be shared with the carrier.

  • Performance of a Sales Agreement or Electronic Service agreement and pre-contractual actions – legal basis: Article 6(1)(b) GDPR; retention period: for the time necessary to perform, terminate, or otherwise expire the agreement.
  • Direct marketing – legal basis: Article 6(1)(f) GDPR; retention period: for as long as the Controller’s legitimate interest exists, but no longer than the limitation period for claims. After a valid objection, data is no longer processed for this purpose.
  • Marketing – legal basis: Article 6(1)(a) GDPR; retention period: until consent is withdrawn.
  • Customer reviews of a concluded Sales Agreement – legal basis: Article 6(1)(a) GDPR; retention period: until consent is withdrawn.
  • Accounting records – legal basis: Article 6(1)(c) GDPR; retention period: 5 years from the beginning of the year following the financial year to which the data relates.
  • Establishing, pursuing, or defending claims – legal basis: Article 6(1)(f) GDPR; retention period: until relevant limitation periods expire.
  • Use of the website and ensuring its proper functioning – legal basis: Article 6(1)(f) GDPR; retention period: for the duration of the legitimate interest.
  • Statistics and traffic analysis – legal basis: Article 6(1)(f) GDPR; retention period: for the duration of the legitimate interest.

DATA RECIPIENTS IN THE ONLINE STORE

Personal data of Service Recipients and Customers may be transferred to the following recipients or categories of recipients:

  • carriers, freight forwarders, courier brokers, and entities handling warehousing or shipping processes;
  • electronic payment and payment card operators;
  • credit providers or leasing companies;
  • providers of review survey systems;
  • providers of technical, IT, and organizational services enabling the operation of the Online Store;
  • providers of accounting, legal, and advisory services;
  • providers of social media plugins, scripts, and similar tools embedded on the website.

The Controller uses only such service providers that provide sufficient guarantees of implementing appropriate technical and organizational measures compliant with the GDPR. Data is transferred only when necessary for a given purpose and only to the extent required.

PROFILING IN THE ONLINE STORE

The Controller may use profiling in the Online Store for direct marketing purposes, but decisions made on this basis do not concern the conclusion or refusal of a Sales Agreement or the possibility of using Electronic Services.

The result of profiling may include granting a discount, sending a discount code, reminding about unfinished purchases, or presenting a Product proposal suited to a person’s interests.

Profiling consists of automatic analysis or prediction of a person’s behavior on the website, for example by adding a Product to the cart, viewing a product page, or analyzing previous purchase history.

The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, if it produces legal effects concerning them or similarly significantly affects them.

RIGHTS OF THE DATA SUBJECT

  • Right of access, rectification, restriction, erasure, or portability – in accordance with Articles 15–21 GDPR.
  • Right to withdraw consent – at any time, without affecting the lawfulness of previous processing.
  • Right to lodge a complaint with a supervisory authority – with the President of the Personal Data Protection Office in Poland.
  • Right to object – to processing based on Article 6(1)(e) or (f) GDPR, including profiling.
  • Right to object to direct marketing – at any time.

COOKIES IN THE ONLINE STORE AND ANALYTICS

Cookies are small text files stored on the device of the person visiting the Online Store website. More information is available here: https://pl.wikipedia.org/wiki/HTTP_cookie.

Cookies may be divided by provider into first-party and third-party cookies, by storage period into session and persistent cookies, and by purpose into necessary, functional or preference, analytical and performance, and marketing, advertising, and social cookies.

The Controller may use cookies to identify logged-in users, remember products in the cart, remember data entered in forms, adjust website content to user preferences, compile anonymous statistics, and perform remarketing.

It is possible to check which cookies are sent by the website using browser settings and external tools such as https://www.cookiemetrix.com/ and https://www.cookie-checker.com/.

Most browsers accept cookies by default. Users can define the conditions for their use in browser settings, although disabling cookies may affect some functionalities of the Online Store.

The Controller may use Google Analytics and Universal Analytics services provided by Google Ireland Limited. Data collected through these services is used for statistics and traffic analysis and may include traffic sources, user behavior, device and browser data, IP address, domain, geographic data, demographic data, and interests.

The Online Store may contain links to other websites. The Controller recommends reading the privacy policies applicable on those websites. This Privacy Policy applies only to the Controller’s Online Store.
